The following rezonings were approved.

  • 4926 Yadkin Road – Property will be rezoned from SF-10 Single Family Residential to CC – Community Commercial.  Property is 1.23 acres in size.  Owned by Hyung Sackos.  Owner wishes to make the property harmonious with surrounding land use.
  • Coalition Boulevard – Property will be rezoned to Business Park Conditional.  The property is owned by the Military Business Park, Inc.  The property is currently being developed as a multi phase business park.
  • River Glen Subdivision on Vandenberg Drive – Property will be rezoned from AR – Agricultural Residential to SF-10 Single Family Residential Conditional Zoning.  The property is 196 acres and is owned by Estate Builders, LLC.  The request will allow up to 682 zero lot line lots.  The Zoning Commission and city staff recommended DENIAL in this case.  Councilman Bates voted in opposition of the rezoning.
    Sidebar: All traffic from the proposed subdivision will go through existing neighborhoods with larger lot sizes.  No additional roads are proposed at this time.
    What Was Said:
    Councilman Bates – “So 3,000 cars will go through someone else’s neighborhood?”
    Craig Harmon (Planner) – “That is one of staffs concerns but there is not a lot of access points to the developer.”

Other Business:

Unified Development Ordinance (UDO) Update – City staff and stakeholders have held various meetings to discuss changes to the Unified Development Ordinance.  For local developers these changes are beneficial to the overall requirements of a project.  For further information please go to the city website www.ci.fayetteville.nc.us

The new revisions are as follows…(from staff report)

  • Individual single-family properties remain exempted from these standards
  • Tree save, open space, and parkland requirements are consolidated as “open space”
  • For nonresidential development including multi-family (more than three unites)
    1 acre or less, no open space requirements
    Redevelopment sites less than five acres – 5% open space is required
    Unimproved sites greater than 1 acre up to 10 acres – 10% is required
    Redevelopment corridor sites 5 acres or greater – reduced to 7.5%
  • For residential subdivision (at least 10% must be on-site)
    Sites greater than 1 acre to 5 acres – 10% open space is required
    Sites greater than 5 acres to 20 acres – 15% is required
    Sites greater than 20 acres – 20% is required
  • Specimen trees (trees 30 inches or more in diameter) or existing trees proposed for credit in landscaping or open space still require location on a site plan and review for any credit in landscaping or open space still require location on a site plan and review for any credit or removal.  Instead of on site replacement when a specimen tree must be removed, $100 per caliper inch may be paid into a tree planting fund.
  • Incentives encourage protection of specimen trees and existing clusters of trees.
  • Other incentives and options are offered for constrained or more urban sites.
  • Stormwater facilities, whether LID or typical stormwater ponds, are more fully integrated into open space standards.
  • Where open space is provided, at least 50% must be usable for passive or active recreation.
  •  Where open space is provided, at least 50% must be usable for passive or active recreation
  • In-lieu-payment may be made for the open space requirement except that for multi-family development over 20 units, at least 50% of the required open space must be provided on site.

Fruit Cobbler

 

Ingredients

2/3 cup flour
2 teaspoons baking powder
1/2 teaspoon salt
2/3 cup sugar
2/3 cup milk
1/2 stick butter or margarine
2 cups sweetened fruit (fresh peaches or blueberries)

Sift flour, baking powder, and salt together.  Add sugar.  Stir in just enough milt to remove lumps.  Melt margarine in Pyrex dish.  Pour batter into center of dish.  Spoon fruit into center of batter.  Do not stir.  Bake at 350 degrees until cobbler has risen and is lightly browned.

What Happened:  The following rezoning’s were voted on as they pertain to the real estate industry.

  • The rezoning of property to BP/CZ (Business Park Conditional) district.  The property is located on Coalition Boulevard and is owned by Military Business Park, Inc.  City staff recommended approval.

Description:  235 acres, currently under developed, property is located between Bragg Boulevard, Santa Fe Drive and the All American Expressway, property will be developed as a multi phase business park

Vote: The Zoning Commission APPROVED this rezoning. The case will move on to the City Council for a final vote in July.

What Was Said:

Jimmy Kizer (Engineer) – “This is a great win win for the city.”

Commissioner Hendrix – “What about the traffic count?”

Kizer – “DOT (Department of Transportation) and the developer has come to an agreement.  DOT is improving that road with clover leaf loops and widening the roads.  It will be phased in as development increases.”

  • The rezoning of property from AR (Agricultural Residential) to SF-10/CZ (Single Family Residential Conditional) zoning.  The property is located in River Glen Subdivision on Vandenberg Drive.  The property is owned by Estate Builders LLC.  City staff recommended denial based on numerous factors to include…

*The significant increase in density (an increase of 213 lots)
*Traffic – traffic will flow through existing neighborhoods with larger lots
*No additional road connections are proposed
*107 lots in the 100 year floodplain
*Open space/community areas are located away from the residential lots

Description: 196 acres, property is vacant and an undeveloped portion of River Glenn Subdivision

(from City memo) The requested conditional zoning allows up to 571 zero lot line lots on approximately 196 acres.  An increase of 213 lots over what is currently approved.  One hundred acres, most of which is floodway or floodplain will be designated as open space.  The typical lot size is 8,700 square feet. 

Vote: The Zoning Commission DENIED the rezoning.  If the applicant does not APPEAL the decision, the case will move forward to the City Council as a denial from the Commission.  The City Council will vote on this rezoning in July.

What Was Said:

Craig Harmon (City Planner) – “He has 213 more lots that what was approved.”

Kizer – “This project started in the county and was annexed into the city.”

Local Boards & Commissions Vacancies

The City of Fayetteville is looking to its citizens to help fill

  • Planning Commission – (a new sign ordinance will be on discussion this year as well as ongoing text amendments within the Unified Development Ordinance. Periodic public hearings on new planning projects)

What Happened:  The following consent items were approved.

  • The Council adopted a resolution opposing House Bill 773 at the General Assembly.  House Bill 773 would render the Rental Action Management Plan unenforceable.  The resolution will assist the City in its efforts to oppose the bill and similar legislation that would limit the City.

Sidebar:  House Bill 773 passed the House and is now on the Senate side.  The bill will be discussed in the Senate Commerce Committee.

(from the City) The City has worked to implement RAMP effectively since July 1, 2012.  The City’s RAMP program is a successful collaboration between code enforcement officials and the police department.  The program is designed to allow the City to more closely monitor rental properties that are the site of repeated or sever code violations or that are the site of certain criminal acts.  Ramp is intended to achieve compliance rather than impose punishment and provides property owners with extensive notice and opportunity to remediate violations.  The program is important to our community as nearly 50% of inhabited dwellings in Fayetteville are renter-occupied, increasing the potential for neglect or code violations.

Other Items of Business:

  • Rebecca Rogers-Carter (Strategic Planning Manager) presented the City Councils FY 2014 Strategic Plan for the City of Fayetteville.  The goals are below.

1. The City of Fayetteville will be a safe and secure community – increase law enforcement community engagement and collaboration, create gang task force, develop traffic safety improvement strategy

2. The City of Fayetteville will have a strong diverse and viable local economy – implement local business initiatives

3. The City of Fayetteville will be designed to include vibrant focal points, unique neighborhoods and high quality, effective infrastructure – increase street maintenance funding, improve gateways

 4. The City of Fayetteville will be a highly desirable place to live, work and recreate with thriving neighborhoods and a high quality of life for all citizens – revisit funding plan for Parks and Recreation, develop traffic flow improvement strategy

5. The City of Fayetteville will have unity of purpose in leadership and sustainable capacity within the organization – City Council recognition of employees, study PWC efficiencies/consolidation opportunities, identify efficiencies through IT to increase effectiveness

6. The City of Fayetteville will develop and maintain strong and active community connections – develop and deliver ongoing coordinated information campaign, develop partnerships

  • The Council approved the Downtown Fayetteville Renaissance Plan

What Happened:  The following rezonings were approved unanimously.

  • The rezoning of 3 acres from Planned Industrial/Conditional Use Overlay for manufactured home sales and Planned Industrial to M(P) Planned Industrial.  The property is located at 2965 Gillespie Street and on the east side of Gillespie Street, southwest of Airport Road.  The application was submitted by Stephen Wheeler and Carla Emmons on behalf of Emmons & Wheeler LLC, and John Tyson on behalf of Cedar Creek Crossing West LLC.
  • The rezoning of 5.38 acres from Heavy Commercial/Conditional Use Overlay for outside storage and Rural Residential to Planned Commercial/Conditional Zoning district for a motor vehicle repair and outside storage.  The property is located at 3427 Clinton Road and is owned by Stephen Ledwell and Andy Nichols.
  • The rezoning of 3.66 acres from Agricultural to Planned Commercial for property located at 5208 NC HWY 87 South and on the west side of NC HWY 87 South.  The owners are Betty Walters and Uta Belletete.
